Edgar R. BELAVAL, Jr.

In his 23 years as an attorney and In-House Litigation Counsel, Edgar has successfully presented more than fifty jury and non-jury cases at trial. These include construction, real estate, contract, commercial and liability cases throughout the state of Florida, as well as the U.S. District Courts for the Southern and Middle Districts of Florida. Edgar has prepared appellate briefs and presented oral arguments in cases before the Third, Fourth and Fifth District Courts of Appeal in Florida, and the United States Court of Appeals for the Eleventh Circuit.

He has represented subcontractors, contractors, real estate developers, manufacturers, distributors, suppliers, trucking and shipping companies doing business in Florida and Latin America in mediation, arbitration and trials.

Fluent in Spanish, Edgar has also negotiated contracts with entities in Panama, Venezuela, the Dominican Republic and Puerto Rico.

Examples of Edgar’s experience:
  • Successfully obtained Summary Judgment on behalf of a general contractor sued in his individual capacity for fraud, fraud in the inducement, negligence and civil theft;
  • Obtained a settlement of all past due amounts on behalf of asphalt subcontractor on an airport project payment bond claim;
  • Awarded all attorney fees and costs for a subcontractor on a lien foreclosure and breach of contract claim of less than $10,000;
  • Represented a general contractor in a $2.75 million unpaid contract balance claim, and defended contractor and surety against municipality’s $10 million alleged defect performance bond claim which settled shortly before jury returned verdict;
  • Successfully recovered past due amounts, attorney fees and costs on behalf of custom steel fabricator in arbitration against private parking garage owner;
  • Represented subcontractor against general contractor recovering on unpaid work and delay claims at non-jury trial;
  • Settled with general contractor and surety on subcontractor’s federal payment bond claim at pre-suit mediation;
  • Obtained a settlement with developer and general contractor’s insurer on behalf of condominium association in multiple construction defect claims totaling more than $15 million;
  • Drafted, negotiated and finalized construction contracts for specialty residential and commercial contractors, both statewide and federal;
  • Served as mediator and settled a complex, 3 year lawsuit between contractor against County on performance bond default claim.
  • Advised large scale painting company on high rise development, during the project, to avoid backcharges, delay claims and damages caused by other trades; and
  • Obtained Summary Judgment on behalf of a residential developer sued in his individual capacity for fraud, fraud in the inducement, negligence, civil theft and punitive damages.
